THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No. 4416 of 2018 ORDER:

This Criminal Petition, under Section 482 Cr.P.C., is filed by the petitioner/ acc used No.2, to quash the proceedings in Cr.No.08 of 2018 pending on the file of Police, P.S. Tamsi, Adilabad District, registered for the offences under Sections 323 IPC and Section 3 (1) (s) of SCs and STs (POA) Amendment Ac t, 2015.

The main allegation made against the petitioner is that the petitioner committed an offence punishable under 323 IPC and Section 3

(1) (s) of SCs and STs (POA) Amendment Act, 2015. During hearing, learned counsel for the petitioner requested this Court to direct the Station House Officer, Tamsi, Adilabad District, to follow the procedure contemplated under Section 41-A Cr.P.C. and the guidelines issued by the Apex Court in Subhash Kashinath Mahajan v State of Maharashtra and another1 Acceding to the request of the learned counsel for the petitioner, the Police of Tamsi Police Station, Adilabad, are directed to follow the procedure contemplated under Section 41-A Cr.P.C., and the guidelines laid down by the Supreme Court in Subhash Kashinath Mahajan v State of Maharashtra and another.
