Petitioner/A8 seeks pre arrest bail in Crime No.40/2017 of Iragavaram Police Station, West Godavari District, Hyderabad, registered for the offences under Sections 143 and 307 r/w 149 IPC. The de-facto complainant gave a report to the Police of Iragavaram Police Station on 16.4.2017 alleging that there were disputes between him and petitioner/A8 who is a Paster of Luthern Church in Antannapet. On 16.4.2017 on the eve of Easter, the complainant went to the church at 10.0 clock and from there he went to tombs of their ancestors to offer prayers to them. At about 5.00 AM one Gude Raviteja and others while going on motor vehicle, the said Raviteja was beaten by Pulagori Rajesh with coconut stem and the said Raviteja told the complainant about the said incident.

Thereafter, on completing the prayers, the complainant and Raviteja questioned Puligori Rajesh as to why he beat him. Thereafter, while the complainant was proceeding to GDM church, the petitioner/A8 took a stick and gave it to other accused and instigated them to kill the complainant and all beat him.

CD file produced by the learned Additional Public Prosecutor contains the wound certificates of victims, showing they suffered simple injuries. Thus, having regard to the strong prima facie case against petitioner/A8, it is not a fit case to grant him anticipatory bail.
