THE HONOURABLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.34164 OF 2017 ORDER:

Heard learned counsel for the petitioner and the learned Government Pleader for Prohibition and Excise (Telangana) appearing for respondent Nos.1 to 4.

The alleged inaction on the part of the respondent authorities in considering the representation, dated 07.09.2017, said to have been made by the petitioner herein is under challenge in the present writ petition.

According to the petitioner herein, it is the owner of the premises bearing H.Nos.3-2-5 and 3-2-6 situated at Kamala Nehru Colony, Armour, Nizamabad District. It is the further case of the petitioner herein that it let out the said premises to the unofficial respondent herein for a period of five years in the year 2010 and the said lease period also came to an end. It is also the case of the petitioner herein that no further lease has been granted in favour of the unofficial respondent herein and as there is no extension of lease, the unofficial respondent herein is not entitled for renewal of the licence for running the Bar and Restaurant in the said premises.

On instructions, it is submitted by the learned Government Pleader at the hearing that no proposals for renewal of the licence for running the Bar have been received so far by the office of the District Prohibition and Excise, Nizamabad and respondent No.5 herein has been permitted to submit all the required documents

i.e., counter part agreement in Form 4-B, trade licence for the year 2017-2018 and registered lease deed along with bank guarantee in Form 3-B(I) for renewal of 2B Bar i.e., M/s.Devi Restaurant & Bar, Armoor.

Since the representation, dated 07.09.2017, is pending consideration before the official respondents herein and as no renewal has been granted in favour of the unofficial respondent herein, this Court, in the facts and circumstances of the case, deems it appropriate to dispose of the present writ petition with a direction to the official respondents to consider the explanation/objections submitted by the petitioner herein and to take action in accordance with law.

With the above direction, the Writ Petition is disposed of. There shall be no order as to costs.

Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
