HON'BLE SRI JUSTICE S.V. BHATT C.R.P.No.5059 OF 2013 ORDER:

Heard Mr.Mahaboob Hussain for petitioner.

Second respondent in O.P.No.150 of 2010 in the Court of the Chairman, Motor Vehicle Accident Claims Tribunal-cum-II Additional District Judge, Karimnagar at Jagitial is the revision petitioner. The revision petitioner filed I.A.No.984 of 2013 under Rule 460 of the A.P. Motor Vehicle Rules read with Section 151 CPC seeking to issue summons to Licencing Authority (RTO), Agra, Uttar Pradesh to give evidence.

The learned trial Judge, by docket order dated 29.10.2003, declined the prayer of petitioner holding that the trial Court had earlier dismissed an application filed for the similar relief by assigning reasons and that the present application is filed making few changes in the relief and that the trial Court would have considered the request of petitioner had the petitioner filed driving licence extract before the Court. Hence, the revision.

I have perused the record. The trial Court has rightly dismissed the application filed by the petitioner. This Court is in agreement with the reasons recorded by the trial Court. No ground warranting interference under Article 227 of the Constitution of India is made out. Revision fails and is, accordingly, dismissed. The trial Court is directed to dispose of O.P.No.150 of 2010 within two months from the date of receipt of a copy of this order. There shall be no order as to costs.

Pending miscellaneous petitions, if any, stands closed. ____________ S.V.BHATT, J 21st August, 2018 Lrkm
