THE HON'BLE SRI JUSTICE P.NAVEEN RAO WRIT PETITION No.39018 of 2014 ORDER :

According to the petitioner, he has applied for grant of building permission for construction of multi storied building in municipal House Nos.11-5-7/8/1, 11-5-7/3/2 and 11-5-7/3, Wyra road, Khammam Town. The building permission was granted on 13.07.2007 and was valid for a period of three years. Even before the permission expired on 05.05.2010 he applied for revalidation of the permission granted on 13.07.2007. But the same was not granted. In the meantime, there are several litigations concerning the same property and because of the pending litigations, the petitioner could not pursue the matter further. However, during pendency of this writ petition, on 30.12.2014, the petitioner has submitted fresh application praying to revalidate the building permission already granted by paying the requisite fee.

2. Learned counsel for the petitioner contends that on the ground that writ petition is pending, the application submitted by the petitioner on 30.12.2014 is not considered so far, causing great hardship and suffering to the petitioner.

3. Having regard to the fact that the application was submitted by the petitioner on 30.12.2014, for revalidation of the building permission granted on 13.07.2007, this Writ petition is disposed of without expressing any opinion on merits, directing the respondent-Municipal Corporation to consider the application dated 30.12.2014 and pass appropriate orders as warranted by law within a period of three (3) weeks from the date of receipt of copy of this order. If the petitioner is aggrieved by any adverse decision, he shall work out his remedies as available in law. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed.
