THE HON'BLE SRI JUSTI CE ABHI NAND KUMAR SHAVI LI CONTEMPT CASE No.973 of 2010 ORDER:

This contempt case is filed consequent upon non-implementation of the orders of this Court, passed in W.P.No.17672 of 2005, dated 23.07.2009.

This Court has disposed of the writ petition with the following observations:

"Having regard to the averments made in the counter affidavit, the respondents are directed to protect the land of an extent of Ac.16.00 in Sy.No.69/1 of Tangellamudi Village, Eluru Mandal and Town, by fencing it completely with the assistance of the police, if required, and see that no encroachments takes place in future."

The present contempt case is filed complaining that the Divisional Engineer (Operation) Eastern Power Distribution Company and the Commissioner, Eluru Municipality have been giving electricity and water connections to the persons who have encroached upon the land, thereby facilitating them to encroach upon the lands. A counter affidavit is filed by respondent No.1 to the effect that they have stopped giving electricity and water connections to the encroachers.

In view of the above statement made by respondent No.1 in his counter affidavit, the Contempt Case is closed. Pending miscellaneous applications, if any, shall stand closed in consequence.
