O R D E R:- The learned counsel for the petitioner has submitted that the petitioner is no more, as such, the prayer is in this writ petition seeking mutation of the petitioner's name in the revenue records as pattadar itself need not be considered at this stage inasmuch as legal heirs of the petitioner are entitled to seek mutation of their names. On the other hand, the learned Government Pleader for Revenue, on

instructions, has submitted that the application made by the petitioner was considered and rejected by the 3rd respondent-Tahsildar by proceedings dated 25.08.2011 on the ground that the other claimants raised a dispute about the rights over the property in question, and the petitioner is required to establish her rights in civil proceedings.

Having considered the submissions made by the learned counsel for both the parties and in view of the fact that the 3rd respondentTahsildar already issued proceedings dated 25.08.2011 rejecting the petitioner's case, this Court does not feel it necessary either to go into the merits of the matter or consider the relief sought for in this writ petition.

Hence, the writ petition is closed, however liberty is given to legal heirs of the petitioners to exhaust the remedies as may be available to them under law. No order as to costs.

As a sequel to the closure of the writ petition, Miscellaneous Petitions, if any pending, shall stand disposed of as infructuous. _______________________ CHALLA KODANDA RAM, J 11.06.2015 bcj
