ORDER
This writ petition is filed seeking to declare the action of respondents 1 and 2 in promoting the 5th respondent as Deputy Director (Handloom & Textiles) vide G.O.Rt.No.284 Industries and Commerce (Tex) Department, dated 8.9.2016 as arbitrary and illegal.
The petitioner states that he was elected as Director to the AP Handloom Weavers Co-operative Society before bifurcation of the State. He is one of the shareholders of the APCO. It appears that an order was passed by the 2nd respondent against the 5th respondent on 16.5.2016.
The grievance of the petitioner is that when no further action was taken pursuant to the said order, he submitted a representation to the Special Chief Secretary & Chairman, Departmental Promotion Commission on 31.8.2016 and the same is not being considered so far.
The order dated 16.5.2016 was passed by the 2nd respondent against the 5th respondent on administrative side. The petitioner cannot maintain the present writ petition against the 5th respondent as the same relates to the service conditions of the 5th respondent.
However, he has the right to make a representation to the concerned authorities, who shall take appropriate action in accordance with law.
In view of the nature of the present writ petition, notice to the 5th respondent is dispensed with and liberty is given to the 1st respondent to consider the representation submitted by the petitioner on 31.8.2016 and dispose of the same as expeditiously as possible. This order is passed without expressing any opinion on the merits of the case.
Accordingly, the Writ Petition is disposed of. No costs. Miscellaneous petitions pending, if any, shall stand closed. ___________________________________ JUSTICE A.RAMALINGESWARA RAO 19th September, 2016 rkk
