.... Petitioner and The State of Andhra Pradesh, rep.by Principal Secretary, Revenue Department, Secretariat, Velagapudi, Guntur district and others.
.... Respondents The Court made the following:
ORDER:
According to learned counsel for petitioner, document was presented for registration in the year 2010 concerning the land in various survey numbers mentioned in the prayer of writ petition. Said document was kept pending on the ground that litigation is pending before various courts including this Court. According to learned counsel, CRP No.1147 of 2012 filed against order in I.A.No.230 of 2009 in O.P.No.34 of 2009 was dismissed as withdrawn on 11.04.2018. He would submit that even after dismissal of CRP, document is not processed. Copy of the order is not enclosed. It is not known whether order copy is already dispatched. Further, the Sub-Registrar, where document is stated to be pending, ought to have been informed of the dismissal of CRP pending before this Court. It appears, no such intimation was given.
In fact, petitioner has not even furnished the pending document number assigned to the document presented by the petitioner. In the absence of these essential aspects, it cannot be held that registering authorities have acted illegally in not registering the document stated to have been presented by petitioner. Thus, leaving it open to petitioner to submit appropriate application before the Sub-Registrar, Pullampet (3rd respondent), where document was presented, Writ Petition is dismissed.
Pending miscellaneous petitions shall stand closed. No costs. __________________________ JUSTICE P.NAVEEN RAO Date: 16.04.2018 kkm
