HON'BLE SMT JUSTICE KONGARA VIJAYA LAKSHMI WRIT PETITION No.10467 of 2007 ORDER:

The Writ Petition is filed questioning notification dated 02.05.2007, under Section 4(1) of the Land Acquisition Act, 1894 (the Act), proposing to acquire petitioner's lands admeasuring Ac.1.95 cents in R.S.No.154/6; Ac.1.20 cents in R.S.No.149/3A, totaling to Ac.3.15 cents, situated at Gopavaram Village, Nidavole Mandal, West Godavari District. While admitting the writ petition on 16.05.2007, this Court stayed the impugned notification dated 02.05.2007. Today, when the matter came up for hearing, a letter dated 25.11.2017 addressed by respondent No.4 to respondent No.3, a copy of which is marked to learned Government Pleader for Land Acquisition, is made available to the Court, wherein it is stated that alternate land in Sy.No.106/8B admeasuring Ac.2.

14 cents, for providing house sites under Indiramma Programme at Gopavaram Vvillages, has been identified; award dated 20.12.2008 was passed and house site pattas to 84 eligible beneficiaries have also been distributed in the year 2009; and there is no necessity to proceed with acquisition of petitioner's lands admeasuring Ac.1.95 cents in R.S.No.154/6; Ac.1.20 cents in R.S.No.149/3A, totaling to Ac.3.15 cents, situated at Gopavaram Village, Nidavole Mandal, West Godavari District.

In view of the letter of respondent No.4 dated 25.11.2017 that the petitioner's land is no longer required for providing house sites under Indiramma Programme, no further orders need be passed in the writ petition. The Writ Petition is, accordingly, closed. However, in the circumstances, without costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
