CVNR, J & MSKJ, J C.M.A.No.1168 of 2001 30.12.2016 JUDGMENT: (Per the Hon'ble Sri Justice C.V.Nagarjuna Reddy) This civil miscellaneous appeal arises out of the order and decree, dated 05.06.2000, in O.P.No.5 of 1996 on the file of the Senior Civil Judge, Tadepalligudem, West Godavari District. 2.

At the hearing, there is no representation for the appellant. 3.

A perusal of the record shows that more than one year after the decree for dissolution, dated 05.06.2000, was passed by the Court below, the same was suspended by this Court on 10.07.2001. The appeal itself was dismissed for default on 04.02.2010 and the same was restored only on 13.10.2014.

Considering the facts that the appeal has become stale and that the appellant has not evinced any interest in pursuing the appeal, the same is dismissed for non-prosecution.

As a sequel to dismissal of the appeal, interim order, dated 10.07.2001, in C.M.A.M.P.No.8456 of is vacated and C.M.A.M.P.No.8456 of 2001 filed by the appellant for interim relief shall stand dismissed as infructuous.
