THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.12903 of 2018 ORDER:
Heard learned counsel for the petitioner and the learned Government Pleader for Civil Supplies. The alleged inaction on the part of the Joint Collector, Ranga Reddy District-second respondent herein, in disposing of the appeal, dated 02.04.2018, preferred by the petitioner herein against the order of suspension of Fair Price shop authorisation passed by the District Civil Supply Officer, Ranga Reddy Districtthird respondent herein on 23.03.2018, is under challenge in the present Writ Petition.
According to the petitioner, he is the dealer of the Fair Price shop No.1585088 situated at Vanasthalipuram, Ranga Reddy District and has been running the said shop for the last 35 years without any complaint. On the ground of certain alleged irregularities, the third respondent passed the order of suspension of the Fair Price shop. As against the said order, petitioner preferred an appeal on 02.04.2018 before the second respondent and, along with the appeal, he also filed an application, seeking suspension of the order passed by the second respondent.
AVSS,J W.P.No.12903 of 2018 It is submitted by the learned counsel for the petitioner that, in the facts and circumstances of the case, the order of suspension passed by the third respondent is not warranted and it is highly illegal, arbitrary and contrary to the Control Order.
On the other hand, it is submitted by the learned Government Pleader that, since a criminal case is registered against the petitioner herein in Cr.No.223/2018, the order of suspension cannot be faulted by the petitioner herein.
The filing of appeal before the second respondent on 02.04.2018 is not disputed by the learned Government Pleader. Since the matter is pending before the second respondent, and having regard to the submissions of the learned counsel for the petitioner and the learned Government Pleader, this Court deems it appropriate to dispose of the Writ Petition with a direction to the second respondent to dispose of the appeal, dated 02.04.2018, filed by the petitioner herein, within a period of four weeks from the date of receipt of a copy of this order, after giving opportunity to the petitioner herein as per law. There shall be no order as to costs.
