THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.5303 of 2001 ORDER:

This writ petition is filed seeking to issue a writ of Certiorari calling for the records relating to the impugned order passed by the 4th respondent dated 28.02.2001 in terminating the petitioner from the service, as arbitrary and illegal and quash the same, and consequently direct the respondents to regularize the services of the petitioner as Secondary Grade Teacher in the 4th respondent Institution.

2. When the matter is taken up for hearing today, learned Government Pleader for School Education submitted that the 4th respondent School has become defunct, and when the 4th respondent School is not in existence, the cause of action in the writ petition does not survive, and therefore, the writ petition has become infructuous.

3. Recording the said submission of the learned Government Pleader for School Education, the writ petition is dismissed as infructuous. No order as to costs.
