THE HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN Writ Petition No.12084 of 2011 ORDER:
The relief sought for in the writ petition is for a mandamus to declare the seizure of the petitioner's vehicle bearing No.AP29U 9987, vide vehicle check report dated 12.11.2010, as illegal and arbitrary. A consequential direction is sought to the 1st respondent to release the vehicle. The check report records that the vehicle was overloaded by 4,660 kgs; a copy of the permit was also not produced; and the subject vehicle was, therefore, seized and kept at Pragnapur bus depot for safe custody.
On the petitioner invoking the jurisdiction of this Court, an interim order was passed in WPMP.No.14779 of 2011 dated 29.04.2011 permitting the petitioner to make an appropriate application before the 1st respondent for release of the vehicle. This Court further directed that, if any such application was made, the same should be considered and disposed of, in accordance with law, within three months from the date of receipt of such application.
As the said interim order was passed nearly seven years ago, and the respondents have been directed to consider the petitioner's application for release of the vehicle, no further orders are necessary in the writ petition; and it would suffice to make the interim order, the final order in the writ petition.
The Writ Petition is, accordingly, disposed of. Miscellaneous Petitions pending, if any, shall also stand disposed of. There shall be no order as to costs.
