HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN AND HON'BLE SMT. JUSTICE KONGARA VIJAYA LAKSHMI WRIT APPEAL No.1073 AND 1533 OF 2005 COMMON JUDGMENT: (per Hon'ble the Acting Chief Justice Ramesh Ranganathan) These two appeals, under Clause 15 of the Letters Patent, are preferred against the order of the Learned Single Judge in W.P. No.8958 of 2004 dated 07.03.2005. By the order under appeal the circular dated 23.04.2004, issued by the Chaitanya Grameena Bank; was set aside; and the appellant bank was directed to provide reservation while affecting promotion of employees from one cadre to another. By an interim order dated 02.01.2006, passed in the Writ Appeal, the order of the Learned Single Judge was stayed.
Sri T. Surya Kiran Reddy, Learned Senior Counsel appearing on behalf of the respondent-writ petitioners, would submit that, in view of the interim order of this Court granting stay of the order Learned Single Judge, reservations in promotions from one cadre to another in the appellant-bank were not given effect to; and, as the order of the Learned Single Judge was passed more than twelve years ago, the cause in the Writ Petition itself does not survive. In the light of the submission made on behalf of the respondentwrit petitioner, by the Learned Senior Counsel appearing on their behalf, suffice it to leave the question of law, whether reservation is required to be provided while affecting promotions from one cadre to another in Chaitanya Grameena Bank, open for consideration, if need be, in appropriate legal proceedings. The Writ Appeals are closed as the cause in the Writ Petition itself does not survive.
