THE HON'BLE SRI JUSTI CE C. PRAVEEN KUMAR WRI T PETI TI ON No.41004_OF 2016 ORDER:

Heard the learned counsel for the petitioners and the learned Government Pleader for Revenue appearing for respondents 1 to 3. With their consent, the present writ petition is disposed of at the admission stage.

Since this Court is not going into the merits of the case, it may not be necessary to issue notice to the 4th respondent. The present writ petition came to be filed with the following prayer:

"to issue an appropriate writ, order or direction, more in the nature of Mandamus, declaring the action of the 3rd respondent by not considering the representation of dismissal and directing the above appeal filed by the 4th respondent vide No.C/1813/2016, dated 02.05.2016 in the matter of agricultural land to an extent of Ac.4.12 guntas in Sy.No.671/A situated at Kandawada village and Grampanchayat, Chevella Mandal, Ranga Reddy District and direct the 3rd respondent to dismiss the above appeal."

As seen from the record, the appeal filed by the unofficial respondent before the 3rd respondent - Revenue Divisional Officer vide No.C/1813/2016 is still pending consideration. If the petitioners have any objection with regard to filing of the appeal and the contents therein, they have to implead themselves in the said appeal and then contest the matter. Mere presentation of representation questioning the very filing of appeal may not serve any purpose and

CPK,J WP_41004_2016 the request of the petitioners to consider their representation cannot be accepted.

Having regard to the above, the Writ Petition is disposed of directing the petitioners to file an application seeking to implead themselves in the appeal and then contest the matter, in which event, the respondents shall consider the same, in accordance with law.
