HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.25468 of 2009 ORDER:

In the present writ petition, the petitioners are challenging the ac tion of the 1st respondent in granting lease hold rights in favour of the 3rd respondent.

Learned counsel for the petitioners submits that the petitioners also have equal rights to that of the 3rd respondent and therefore appropriate orders be passed in the writ petition directing the 1st respondent to c onsider the cases of the petitioners for grant of lease hold rights in their favour on par with the 3rd respondent.

Learned Standing Counsel as well as the learned Government Pleader appearing for the respondents submit that the 1st respondent would consider the cases of the petitioners for grant of lease hold rights, in accordance with law, if they submit fresh representation to the 1st respondent.

This Court, having considered the rival submissions made by the learned counsel for the respective parties, is of the considered view that this writ petition can be disposed of directing the petitioners to submit a fresh representation to the 1st respondent seeking lease hold rights in their favour, on par with the 3rd respondent, within a period of two weeks from the date of receipt of a copy of this order. Upon such representation being received, the 1st respondent shall consider the same and pass

appropriate orders in accordance with law within a period of eight weeks thereafter.

With the above observations, the writ petition is disposed of. No order as to costs.
