Heard learned counsel for the petitioners and the learned Standing Counsel for respondent Nos.3 and 4.

It is the case of the petitioners that they are poor and below poverty line people, engaged in petty businesses and eking out their livelihood by self employment. While so, respondent No.4 constructed a shopping complex in 1970 and allotted shops to the petitioners and others and the lease had already expired in 2011. The petitioners filed W.P.No.8453 of 2012 and by virtue of the interim order granted therein, one of the petitioners continued, however no action was taken by respondent Nos.3 and 4 with regard to other petitioners. Now, when a notice was issued on 18.08.2017 by respondent No.4 asking the petitioners to vacate the shops on the ground that the lease period expired, the present writ petition is filed.

There is no dispute that the petitioners were put in possession of the shops under a lease agreement entered on 15.11.2006 and the lease expired on 15.10.2011. Thereafter, there was no continuance of lease, but the petitioners were allowed to continue. Now, the notice, dated 18.08.2017, was

issued in order to enable respondent Nos.3 and 4 to put the leasehold rights in open auction.

In the circumstances, it is open to the petitioners to participate in the auction to be held by respondent Nos.3 and 4 for the leasehold rights of the shops and the petitioners shall be continued till the auction is finalised.

The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in this writ petition shall also stand closed. There shall be no order as to costs. ________________________ A.RAMALINGESWARA RAO,J Dt:31.08.2017 kdl
