HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITON No.13167 of 2018 ORDER:

The case of the petitioners is that the 2nd and 3rd petitioner are the institutions which are under the control of the 1st petitioner. The Teaching and Non-Teaching posts in petitioner-institution have been admitted to grant in aid by the Government. As some posts fell vacant, the 1st petitioner management submitted proposal in respect of the 2nd petitioner-institution on 05-01-2018 seeking permission to fill-up the vacancies to the 2nd respondent and also submitted proposal on the same day in respect of the 3rd petitionerinstitution seeking permission to fill-up the aided vacancies, as the Government lifted ban on 03-12-2016. Subsequently also, the Government has issued G.O.Ms.No.40 School Education (B.S.

Department), dated 30-06-2017 permitted all the District Educational Officers/Regional Joint Director of School Education to grant temporary permission to all the Management of Aided Schools covered in all court cases and judgment of this Court in WP.No.9503 of 2005 and Batch, dated 30-07-2013 subject to outcome of W.Ps/W.As/S.L.Ps etc., As no action has been taken by the respondents, the present writ petition is filed.

Heard Sri K.G.Krishnamurthy, learned Senior Counsel for the petitioners and learned Assistant Government Pleader Education (Services) for the respondents.

Having regard to the above, there shall be direction to the 2nd and 3rd respondent to consider the proposals submitted by the petitioners in accordance with Rules.

Accordingly, the writ petition is disposed of. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
