THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.4426 of 2018 ORDER:

This Criminal Petition, under Section 482 Cr.P.C., is filed to quash the proceedings against the petitioner in Crime No.79 of 2018 of IV Town Police Station, Nellore, SPSR Nellore District, registered for the offences punishable under Sections 324 r/ w 34 IPC and Section 3 (i) ® (s) of SCs and STs (POA) Act.

After arguing the matter for awhile, learned counsel for the petitioners, requested this Court to direct the concerned to follow the procedure contemplated under Section 41-A Cr.P.C., and the guidelines issued by the Apex Court in Arnesh Kumar v. State of Bihar and another1 In view of the request made by the learned Counsel for the petitioners, the Police of Nellore IV Town Police Station, S.P.S.R. Nellore District, are directed to follow the procedure contemplated under Section 41-A Cr.P.C., and the guidelines laid down by the Supreme Court in Arnesh Kumar's case referred supra.

With the above direction, this Criminal Petition is disposed of. As a sequel, miscellaneous applications pending, if any, shall stand closed.
