By way of this application filed under Section 11 of Arbitration and Conciliation Act, 1996 (for short "the Act"), the petitioner seeks appointment of an Arbitrator for resolution of disputes arising under the terms of the provisional application form-cumagreement dated 27-03-2010 entered into by and between them. Learned counsel for the respondent on the last occasion stated that the parties to this application have settled the matter between themselves in the light of the orders passed in OP No.2 of 2014 by the IX Addl. Chief Judge, City Civil Court, Hyderabad, and nothing survives for adjudication in this application. But, as the learned counsel for the petitioner was not present, the matter was directed to be listed today under the caption "for dismissal." Today also none appears for the petitioner. No representation either. In the circumstances, recording the submission made by the learned counsel for the respondent, the arbitration application is closed. No order as to costs.
