HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No. 4251 of 2019 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking quashing of the proceedings in S.C.No.41 of 2017 on the file of the V Additional District Judge-cum-SCs/ STs Special Court, Medak at Sangareddy.

A charge sheet came to be filed against the petitioners for the offences punishable under Sections 452, 324 and 506 read with 34 IPC and Sections 3 (2) (v) (a) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Act.

Though the present Criminal Petition is filed seeking quashing of entire proceedings, but during the course of arguments learned counsel for the petitioners restricts his prayer seeking dispensation of the presence of the petitioners 2 to 4 before the trial Court on every date of adjournment.

The learned Public Prosecutor submits that since the identity of petitioners is not in dispute, their presence in the above S.C. may not be necessary on every date of adjournment.

Having regard to the facts and circumstances of the case, the personal appearance of the petitioners 2 to 4/ A2 to A4 in S.C.No.41 of 2017 on the file of the V Additional District Judge-cum-SCs/ STs Special Court, Medak at Sangareddy, is hereby dispensed with except on the dates when their presence is specifically required by the Court. However, they shall be represented by their counsel. It is made clear that such relief cannot be granted to the petitioner No.1/ A1 and he has to attend the trial Court regularly.

With the above direction, the Criminal Petition is disposed of. As a sequel thereto, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
