This revision is filed by the petitioner/ 1st defendant, aggrieved by the order dated 15.11.2017 in I.A.No.209 of 2015 in A.S.No.260 of 2007 passed by the III Additional District Judge, Prakasam District at Ongole.

Heard before admission and ordering notice to the respondents and perused the impugned order.

The said I.A. was filed by the 1st defendant to restore the appeal, which was dismissed for default for not taking steps to bring the legal representatives of the 1st respondent to the appeal, who was sole plaintiff and in the present revision, they are shown as respondents 10 and 11.

In fact, there is no bar for the revision petitioner/ 1st defendant to file a fresh application before the lower Court for restoration of the appeal, by virtue of this order, otherwise if at all any application is filed by showing the proposed legal representatives of the 1st respondent/ plaintiff as parties to the application to implead them within fifteen days from the date of receipt of copy of this order. 5.

With the above directions and observations, the Civil Revision Petition is disposed of.

Consequently, miscellaneous petitions, if any shall stand closed. No order as to costs.
