THE HONOURABLE SRI JUSTICE K.SURENDER CRIMINAL PETITION No.5519 OF 2023 ORDER:

This Criminal Petition is filed under Section 438 of the Code of Criminal Procedure, 1973 seeking bail to the petitioner - accused in the event of his arrest in C.C.No.327 of 2017 pending on the file of learned II Additional Junior Civil Judge-cum-II Additional Metropolitan Magistrate, Malkajgiri, filed for the offences punishable under Sections 417, 418, 420, 423 and 464 of Indian Penal Code. 2.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent - State. 3.

The petitioner is seeking the relief of anticipatory bail in the above calendar case on the ground that non-bailable warrants were issued against him.

Learned counsel appearing for the petitioner would submit that petitioner has assisted investigation and charge sheet was also filed. Petitioner has proceeded to U.S.A. for employment purpose and he never willfully avoided Court proceedings. Having come to know about the said pending case and NBWs are pending against him, he has returned from U.S.A. and now staying in India. He

further submits that the next date of hearing in the Court below is 28.06.2023.

In the said circumstances, the petitioner shall appear before the learned II Additional Junior Civil Judge-cum-II Additional Metropolitan Magistrate, Malkajgiri, on 28.06.2023 and surrender his passport to the said Court. Further, the learned Magistrate shall recall the warrants pending against the petitioner, subject to the petitioner furnishing a personal bond for an amount of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties for the like sum each. The petitioner shall appear before the trial Court on each and every date of hearing without fail.

Needless to say, the learned II Additional Junior Civil Judgecum-II Additional Metropolitan Magistrate, Malkajgiri, shall undertake trial on day to day basis as required under Section 309 of Cr.P.C. 7.

With the above observations, the Criminal Petition is disposed off.

As a sequel thereto, miscellaneous applications, if any pending, shall stand closed.
