HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO Crl.P.No.5988 of 2015 ORDER :

This petition is filed under Section 482 of the Code of Criminal Procedure (for short, 'the CrPC') by the Petitioners/A.1 to A.3 to quash proceedings in C.C.No.320 of 2011 on the file of the VII Addl.Chief Metropolitan Magistrate, Hyderabad, registered for the offence punishable under Section 435 of I.P.C.

2) The Petitioners and 2nd respondent/defacto-complainant present before the Court and the defacto-complainant stated that he was also paid compensation for the damage to the vehicle that was caught in the fire and the claims were settled between them amicably outside the Court through elders and to that effect the petitioner filed a petition in Crl.P.M.P.No.5924 of 2015, praying to permit to compound the offence in view of their compromise and another petition Crl.P.M.P.No.5925 of 2015 to record.

3) Having regard to the above, the defacto-complainant is permitted to compound the offence under Section 435 of I.P.C. by invoking Section 482 of Cr.P.C., in the interest of justice and in view of their compromise.

4) Accordingly, the petition is allowed and all the proceedings in C.C.No.320 of 2011 on the file of the VII Addl.Chief Metropolitan Magistrate, Hyderabad are quashed. The bail bonds of the petitioners, if any, shall stand cancelled.

5) Miscellaneous petitions, if any pending, in this Criminal Petition shall stand closed.
