CVNR, J & MSKJ, J in/& FCA.No.112 of 2016 Dt: 05.01.2017 Common Judgment : (Per Hon'ble Sri Justice C.V.Nagarjuna Reddy) Feeling aggrieved by the Order and Decree, dated 15.12.2014, in FCOP.No.96 of 2008 filed by the respondentwife whereby the marriage between the parties has been dissolved and also permanent custody of the minor childAdarsh Srivathsa Praturi was given to the respondent, this Family Court Appeal (FCA) is filed by the appellant- husband. Both the parties have filed FCAMP.No.1 of 2017 to record compromise and dispose of the FCA in terms of the Memorandum of Understanding, dated 22-11-2016, containing terms A to Q.
At the hearing, both the parties are personally present. They have re-affirmed the terms of the aforesaid Memorandum of Understanding. The appellant has handed over Fixed Deposit Receipt, dated 28-12-2016, for a sum of Rs.22 lakhs taken in the name of the minor child- Adarsh Srivathsa Praturi, and Manager's Cheque bearing No.334084, dated 21-12-2016, for Rs.14 lakhs drawn in favour of the respondent, at the HDFC Bank, Hi-Tec City Branch, to the respondent. Both the parties have informed the Court that they will strictly abide by
CVNR, J & MSKJ, J in/& FCA.No.112 of 2016 Dt: 05.01.2017 the terms of Memorandum of Understanding and requested for modifying the order of the lower Court in terms thereof. Accordingly, FCAMP.No.1 of is allowed, Memorandum of Understanding, dated 22-11-2016, is taken on record and FCA.No.112 of 2016 is disposed of by incorporating the terms of the said Memorandum of Understanding with the direction to the Registry to draft the decree in terms thereof.
As a sequel, FCAMP.No.424 of 2016, filed by the appellant for interim custody of the minor child, is disposed of as infructuous.
