HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 703 of 2008 Order:

This Writ Petition was filed challenging the action of the respondents in refusing to recognize the petitioner as qualified person under the Drugs and Cosmetics Act, 1940 and the Rules made thereunder, though it is the case of the petitioner that the licence for the shop is being renewed from time to time for the last 45 years. Now the respondents stated that they did not renew the licence unless the petitioner possesses the qualifying examination conducted by the Government of Andhra Pradesh. But, no order of the Government is filed along with the Writ Petition. In the absence of any cause of action, on the basis of mere apprehension no relief can be granted to the petitioner. The petitioner was aged about 68 years when the Writ Petition was filed in the year 2007 and the learned counsel for the petitioner fairly submitted that in view of the age of the petitioner and relief sought in the Writ Petition, no further orders are required in the present Writ Petition. The Writ Petition is, accordingly, closed. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
