HON'BLE SRI JUSTICE U. DURGA PRASAD RAO Criminal Petition No.2082 of 2015 ORDER:

In this petition filed under Section 482 Cr.P.C., petitioner/complainant seeks to set aside/quash the order dated 31.12.2014 passed in Crl.R.C.No.383 of 2014 by learned Metropolitan Sessions Judge, Hyderabad whereunder learned Judge confirmed the order dated 09.09.2014 passed by learned VIII Additional Chief Metropolitan Magistrate, Hyderabad in S.R.No.517 of 2014 and dismissed the private complaint filed by the complainant under Section 203 Cr.P.C. holding that the dispute between the parties who are none other than the brothers and sisters, is purely a civil dispute and the allegations do not prima facie attract the offences under Sections 406, 417, 418, 420, 447 and 109 r/w 34 IPC.

Heard.

Upon hearing the complainant and perusing the impugned orders, this Court endorse the view taken by the Courts below to the effect that the transactions touching the disputes between the complainant and accused are purely civil in nature and they do not attract the criminal prosecution and hence the complainant can pursue his remedy before appropriate Court. Accordingly this Criminal Petition is dismissed. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
