HON'BLE SRI JUSTICE C.PRAVEEN KUMAR CRIMINAL PETITION No. 3867 of 2015 ORDER:
The petitioner, who is accused No.1, filed the present application under Sections 437 & 439 Cr.P.C. seeking enlargement on bail in S.C.No.658 of 2013 on the file of the Additional Metropolitan Sessions Judge, Cyberabad at L.B.Nagar, Ranga Reddy District. A charge sheet came to be filed against the petitioner and others for the offences punishable under Sections 302, 201 r/w 109 and 212 Part I IPC.
Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the respondent-State.
It is represented by learned counsel for the petitioner that the petitioner was arrested on 22.12.2006 and released on bail on 22.05.2007. It is stated that since then the petitioner is regularly attending the Court and only in the month of January, 2015 he could not attend the Court. The non-bailable warrants issued against him due to his absence on one particular date were executed and the petitioner is now lodged in jail from 30.01.2015.
If the petitioner was absent only on one day, as contended by the petitioner, he shall be released on bail on his executing a bond for Rs.25,000/- (Rupees Twenty Five thousand only) with two local sureties for a like sum each to the satisfaction of the concerned Court. Further, the petitioner shall furnish proof of his address like aadhar card or ration card at the time of executing the bond. The Court while accepting the sureties shall verify their antecedents and also the proof of their address. It is made clear that the petitioner shall appear before the Court on every date of adjournment and if he fails to do so, the trial Court shall take all possible steps for arrest and also take steps against the sureties. Accordingly, the Criminal Petition is disposed of. _______________________________
