THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.3368 OF 2015 ORDER:

The present criminal revision case is filed by the petitioner challenging the order, dated 27.10.2015, passed in Crl.A.No.86 of 2015 by the Court of the Special Judge for Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act-cum-V Additional District and Sessions Judge, Medak at Sanga Reddy, whereby the Court below dismissed the appeal by confirming the order passed in Crl.M.P.No.433 of 2014 in D.V.C.No.433 of 2014 by the Additional Judicial First Class Magistrate, at Sanga Reddy, whereby the trial Court allowed the petition filed by the second respondent herein directing the petitioner herein to pay maintenance amount of Rs.2,000/- (Rupees two thousand only) per month to the second respondent herein. Heard and perused the records.

Learned counsel for the petitioner submits that the petitioner herein is unable to pay the interim maintenance amount of Rs.2,000/- per month to the second respondent herein and as such, prays this Court to reduce the maintenance amount. Considering the facts and circumstances of the case, the criminal revision case is disposed of with the following directions.

(i) The petitioner herein is directed to pay 50% of the interim monthly maintenance ordered by the Court below, i.e., Rs.1,000/- (Rupees one thousand only) to the second respondent herein on or before 10th of every succeeding month; (ii) The petitioner is also directed to pay the arrears of maintenance amount calculating at 50% of the maintenance amount ordered by the Court below, within a period of three months from the date of this order; and (iii) The trial Court is directed to dispose of D.V.C.No.433 of 2014 as expeditiously as possible, preferably within a period of six months, without being influenced by order of this Court.

With the above directions, the Criminal Revision Case is disposed of. Consequently, the miscellaneous petitions filed in this revision, if any, shall stand closed. _____________________ JUSTICE RAJA ELANGO 05.01.2016 pln
