THE HONOURABLE SRI JUSTICE J. SREENIVAS RAO CRIMINAL PETITION No. 6343 of 2025 ORDER:

This Criminal Petition is filed under Section 482 of Bharatiya Nagarik Suraksha Sanhitha, 2023 (for short 'BNSS') seeking bail to the petitioner/accused in Crime No.271 of 2025 on the file of Police Station, Jubliee Hills, registered for the offences punishable under Sections 69, 74 and 79 of Bharatiya Nyaya Sanhitha, 2023 (for short 'BNS') 2.

The case of the prosecution is that on 07.04.2025, a complaint was lodged by the complainant alleging that the complainant and the petitioner worked in a private limited company and used to hang out at a pub along with other colleagues. Subsequently, they became close and started living together in the flat of the complainant. The petitioner proposed to marry the complainant after her sister's wedding. Believing his words, the complainant even participated in sexual intercourse. When the complainant insisted for marriage, the petitioner did not turn up and switched off his phone. Even the parents of the petitioner did not respondent to her phone calls. Basing on the same, the present complaint is filed.

Heard B.Chinnapa Reddy, learned counsel for the petitioner and Mr.D. Arun Kumar, learned Additional Public Prosecutor for the respondent-State.

Learned counsel for the petitioner submitted that the petitioner has not committed the offences and he was falsely implicated in the above crime. Even according to the allegations made in the complaint, the ingredients under Sections 69, 74 and 79 of the BNS are not attracted against the petitioner. He further submitted that the petitioner is ready and willing to cooperate with the investigation and will abide by the conditions, which are going to be imposed by this Court and hence, prayed for anticipatory bail. 5.

Per contra, learned Additional Public Prosecutor submitted that the petitioner and other accused have committed grave offence and the investigation is under progress. Therefore, if the petitioner is granted bail, there is every chance to influence the witnesses and to interfere with the investigation. Hence, prayed to dismiss the petition.

Having considered the submissions made by respective parties and after perusal of the material available on record, it reveals that the petitioner and de facto complainant has known to each other since 2023. Even according to learned Additional Public Prosecutor, the petitioner is not having any criminal antecedents.

Taking into consideration the facts and circumstances of the case, this Court is inclined to grant anticipatory bail to the petitioner/accused subject to the following conditions:

1. The petitioner /accused shall surrender before the Station House Officer of Jubliee Hills Police Station, on or before 13.05.2025, and on such surrender, the said Station House Officer shall release the petitioner/accused on bail on the petitioneor executing a personal bond for Rs.30,000/- (Rupees Thirty Thousand only) with two sureties, for the like sum each to his satisfaction.

2. On such release, petitioner/accused shall appear before the S.H.O Jubliee Hills Police Station, on every Monday at 11-00 a.m. for a period of eight (8) weeks or till filing of the charge sheet, whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

3. After release, the petitioner/accused shall not influence the witnesses or interfere with the investigation.

4. Petitioner/accused shall abide by the conditions stipulated under Section 482(2) of the BNSS and shall cooperate with the Investigating Officer in the investigation.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, pending if any, shall stand closed.
