HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 30646 of 2017 Order:

This Writ Petition is filed seeking a direction to consider the legal notice dated 18.01.2017 and the representation dated 29.05.2017 issued on behalf of the petitioner.

The case of the petitioner is that his grand father was the pattadar and was in possession and enjoyment of the land of an extent of Ac.0.07 gts. in Survey No.155, Ac.0.16 gts. in Survey No.156, Ac.0.19 gts. in Survey No.174 and Ac.0.07 gts. in Survey No.198 of Deshaipet village, Warangal Mandal, Warangal District. The second respondent initiated land acquisition proceedings while excavating the Canal for establishing Pratap Rudra Filter Bed through Kakatiya Canal and the said lands were utilized for excavating the Canal, but the compensation was paid for Ac.0.16 gts. of land situated in Survey No.156 only. In respect of the other lands, no compensation was paid. In those circumstances, they issued the above legal notice.

Beyond the above facts, no other facts with regard to land acquisition are mentioned. When this Court orally asked the learned counsel for the petitioner, he submitted that the acquisition took place in the year 1994. If that is so, what the petitioner was doing for the last 23 years is not explained in the affidavit. In the circumstances, this Court does not entertain the present Writ Petition for laches. The Writ Petition is, accordingly, dismissed. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions pending in this Writ Petition, if any, shall stand closed.
