THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.2337 OF 2016 ORDER:

This Criminal Petition is filed under Section 482 of Code of Criminal Procedure (Cr.P.C.) to quash the proceedings in C.C.No.293 of 2014 on the file of the IV Metropolitan Magistrate, Bhimunipatnam, Visakhapatnam District, arising out of offences under Sections 448, 147, 352, 509, 506 read with Section 34 IPC.

Heard and perused the material available on record. Learned counsel for the petitioners submits that even in the investigation, nothing is elicited against the petitioners herein and as such, he prays this Court to quash the proceedings against the petitioners herein.

Considering the facts and circumstances, this Court is of the view that the petitioners are given liberty to file an application raising all the grounds seeking discharge and the Court below is directed to consider the application on hearing the petitioners and on perusing the records and pass appropriate orders in accordance with law. Till then, the presence of the petitioners is dispensed with before the Court below.
