Katha Devadas v. The Principal Secretary To Government And 5 Others
Date : 23.7.2019 Between:
Katha Devadas s/o Ailaiah age 60 years Occu Pensioner H No 22-11 Kasturiba Colony Husnabad Town and Revenue Mandal Siddipet District Petitioner And The Principal Secretary to Government Municipal Administration Secretariat Buildings Hyderabad and 5 others Respondents The Court made the following:
ORAL ORDER:
Heard learned counsel for petitioner and learned Government Pleader for Revenue.
2.
Writ petition is filed praying to direct the respondents to act upon the complaint stated to have been filed by the petitioner on 12.7.2019 for demolition of house constructed by 6th respondent alleged to be illegally constructed without obtaining building permission and on the basis of fraudulent possession certificate. 3.
From the reading of the representation dated 12.7.2019 it is apparent that petitioner is seeking to claim a portion of land in Survey No. 214/A and 214/B, Husnabad Revenue village and mandal, Siddipet district based on document stated to have been signed by unofficial respondents on 6.11.2015 agreeing to sell the land to petitioner, which is not registered. In other words, petitioner is seeking enforcement of the promise alleged to have been made by unofficial respondents to give subject land. Therefore, petitioner requested the competent authority not to issue Ownership Recognition Certificate to 6th respondent. Further, the said representation was made only on 12.7.2019 and within few days this writ petition is filed. Even assuming that there is merit in the claim made by the petitioner, petitioner cannot expect authorities to act immediately as soon as a representation is made and allege inaction. Thus, on this ground also writ petition is liable to be dismissed. Further, prayer sought in the representation is different from the prayer sought in
the writ petition and on that ground also the writ petition cannot be entertained.
4.
The writ petition fails and accordingly dismissed leaving it open to the petitioner to work out remedies available to him against unofficial respondents. Miscellaneous petitions, if any pending, are closed.
