THE HON'BLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION Nos.4988 and 13561 of 2012 COMMON ORDER:

These two writ petitions are being disposed of by this common order as they arise out of the same cause of action. W.P. No.4988 of 2012 was filed challenging the order of respondent No.1 dated 21.02.2012 dismissing the appeal, preferred by the petitioner, confirming the order passed by respondent No.2 on 07.12.2011 cancelling the Bar licence of M/s. Sumanth Restaurant and Bar.

W.P. No.13561 of 2012 was filed challenging the order of respondent No.2 dated 04.04.2012 dismissing the appeal preferred against the order dated 01.12.2011 passed by respondent No.4 cancelling A4 licence in respect of M/s.Sumanth Wines. These writ petitions are filed in the year 2012 and in view of lapse of time and due to bifurcation of the State nothing survives for adjudication in the present writ petitions. Accordingly, both the writ petitions are dismissed as having become infructuous. No order as to costs.

At this stage, learned counsel for petitioners submits that with regard to the seized stock the petitioners may be given liberty to take appropriate proceedings in accordance with law. It is needless to mention that since the impugned proceedings are confined to cancellation of Bar licence and licence to the wines shop, it is open to petitioners to take appropriate proceedings in accordance with law with regard to the seized stock.

Miscellaneous Petitions, if any, pending in these writ

petitions shall stand closed.
