HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.22612 of 2006 ORDER :
When the writ petition is taken up for hearing, it is noticed that the writ petition against respondent No.2 - Workman was already dismissed for default vide order dated 23.06.2011. Thereafter, the petitioner has not taken any steps for restoration of the writ petition against respondent No.2. As the petitioner challenges the Award in I.D.No.258 of 2001 passed by respondent No.1, which was notified vide G.O.Rt.No.2254 LET & F (Lab-I) Department, dated 09.11.2005, published on 04.02.2006, in favour of respondent No.2 - Workman, unless the writ petition is restored against respondent No.2 - Workman, who is a proper and necessary party, this writ petition cannot be adjudicated on merits. Accordingly, the writ petition is dismissed. No order as to costs.
As a sequel, miscellaneous petitions pending, if any, in this writ petition shall stand closed.
