B/O RRB 09.12.2021 LK,J I.A.NO.1 OF 2021 Petitioner/A-2 filed this application to relax the condition imposed by this Court by order dated 18.08.2021 whereby the petitioner was directed to appear before the investigating officer on every alternative day between 9.00 am and 5.00 pm till completion of the investigation and filing of the charge sheet. Sri T. Pradyumna Kumar Reddy, learned Senior Counsel appearing for the petitioner/A-2, submits that petitioner has been complying with all the conditions of the bail orders of this Court and he has appeared about fifty times before the police till now. The petitioner is engaged in a business, which is currently facing loss due to his absence on every alternative day and hence, the said condition may be relaxed.

On the other hand, learned Assistant Public Prosecutor concedes to the fact that the petitioner has been complying with the conditions of the bail orders and submits that investigation is pending and they are yet to file charge sheet. He also submits that the petitioner is not cooperating with the investigation.

In view of the submissions made on either side and considering the fact that the petitioner has been complying with the conditions imposed, this Court deems it appropriate to modify condition No.(ii) of the order dated 18.08.2021 and the petitioner/A-2 is directed to appear before the investigating officer once in a month i.e. on first Sunday of

CRL.P.NO.5868 OF 2021 every month between 9.00 am and 5.00 pm till the completion of investigation and filing of charge sheet. He is further directed to cooperate with the investigation.

The I.A. is ordered, accordingly.
