HON'BLE SRI JUSTICE A. RAJASHEKER REDDY WRIT PETITION No.29993 OF 2017 ORDER:

This Writ Petition is filed challenging paragraph No.2 of showcause notice No.1018/B1/HGs.Hyd/2017, dated 22.08.2017, on the ground that it is bereft of details and it will not be possible to answer the said vague allegations.

2. Heard learned counsel for the petitioner, who submits that the show-cause notice is vague, as such, petitioner is not in a position to file reply.

3. Learned Assistant Government Pleader for Services submits that already charge sheet was filed in the criminal case in Crime No.182 of 2017 of Choutuppal Police Station, which is referred to in paragraph No.1 of the show-cause notice. He further submits that the petitioner has to submit explanation to the show-cause notice.

4. It is to be seen that the grievance of the petitioner is only regarding paragraph No.2 of the show-cause notice. If the petitioner is not evading the orders of the superior officers, he can simply state in his explanation to the show-cause notice that he is not evading the orders of the superior officers. Ordinarily, this Court will not interfere at the stage of show-cause notice, except in the case of lack of jurisdiction of issuing authority.

5. In view of the same, it is open for the petitioner to file explanation to the show-cause notice, dated 22.08.2017, within a period of four weeks from today. On filing such explanation, respondent No.1 is directed to pass orders by considering the explanation of the petitioner in accordance with law. If any order is passed against the petitioner, he is at liberty to challenge the same by raising all grounds, which are raised now.

6. With the above direction, the Writ Petition is disposed of. Miscellaneous Petitions, if any, pending in this Writ Petition shall stand closed. There shall be no order as to costs. __________________________ A. RAJASHEKER REDDY, J September 12, 2017 MD
