HON'BLE SRI JUSTICE C. PRAVEEN KUMAR CRIMINAL REVISION CASE No.2563 OF 2014 ORDER:
Aggrieved by the order dated 10.12.2013 in Crl.M.P. No.631 of 2013 in Crl.M.P.No.754 of 2011 in M.C. No.30 of 2007 on the file of the Judge, Family Court-cum-IV Additional District Court, Krishna at Vijayawada, the present revision is filed under Sections 397 and 401 Cr.P.C.
The facts in issue are as under :
On 20.11.2013, this court while disposing of the Criminal Revision Case No.2414 of 2013 directed the petitioner "to appear before the learned Magistrate on 10.12.2013 and make an application to recall the N.B.W. and on such application being made, the learned Magistrate was directed to consider and dispose of the same on the same day". Pursuant to the said order, the petitioner herein is alleged to have appeared before the Court. It is stated that on that day as the Seemandhra agitation was going on, the petitioner, who appeared, was directed to serve notice on the respondent. In that process, the Court is said to have passed an order holding that the petitioner was absent and directed the police to proceed further with the execution of warrants. Challenging the same, the present revision is filed. On 19.12.
2013, this Court while admitting the revision, granted stay of execution of N.B.Ws. against the accused for a period of eight weeks, which was extended from time to time. It is stated that pursuant thereto, the petitioner is regularly appearing before the Court and that he also paid an amount of Rs.40,000/- towards arrears.
is appearing before the court regularly, the N.B.Ws. issued on 10.12.2013 against the petitioner is recalled on his executing a bond for Rs.10,000/- (Rupees ten thousand only) to the satisfaction of the said court and on a further condition that the petitioner shall appear before the trial court on every date of adjournment without fail. Accordingly, the Criminal Revision Case is disposed of. As a sequel to it, miscellaneous petitions pending if any in this Criminal Revision shall stand closed.
