HON'BLE SRI JUSTICE R.KANTHA RAO W.P.No.33030 of 2015 ORDER:

This writ petition is filed seeking to declare the proceedings dated 2.6.2015 issued by the 2nd respondent as arbitrary and illegal.

The petitioner was appointed as Field Assistant under MGNREG Scheme Project, Chilakaluripet Mandal, Guntur District in 2009.

While so, on the allegation of misappropriation of funds, he was kept under suspension vide impugned proceedings dated 2.6.2015.

Learned counsel appearing for the petitioner submits that though the petitioner has nothing to do with the misappropriation of funds, he was unnecessarily kept under suspension and therefore, the impugned proceedings are liable to be set aside.

On the other hand, learned Special Counsel appearing for the respondents would submit that the order impugned is an order pending enquiry and the charge includes misappropriation of funds and therefore, it needs no interference.

Considering the submissions made by the learned counsel on either side, the Writ Petition is disposed of directing the 2nd respondent-Project Director to complete the enquiry and pass final order within a period of eight weeks from the date of receipt of a copy of this order, failing which the suspension order shall stand revoked. There shall be no order as to costs.

Miscellaneous petitions, if any, pending in this writ petition

shall stand closed.
