Heard Mr. P. Raghavendra Rao for petitioner and learned standing counsel for respondents.

Petitioner prays for Mandamus declaring inaction of respondents in paying ex-gratia as per S.O.O.(CGM-HRD)Rt.No.761 dated 26.10.2013 even after lapse of three years as illegal, arbitrary and unconstitutional.

The case of petitioner is that on 17.01.2014 petitioner's son was standing near a Jilebi shop adjacent to a transformer at Geetha Bhavan Road, Gudivada Town, the hoarding erected next to the place where he was standing collapsed and one of the ends of the hoarding touched the transformer, which resulted in electrocution and death of petitioner's son. Petitioner claims to have been making representations for payment of compensation for the death of her son due to electrocution. After lapse of several years and before completely losing hope, the present writ petition is filed complaining inaction against respondents.

At request of respondents on 24.11.2016, the writ petition has been adjourned to today. The standing counsel, on instructions, submits that the representation dated 30.09.2016 will be positively, expeditiously considered and disposed of within four (4) weeks from the date of receipt of copy of this order.

By accepting the statement made by learned standing counsel, the writ petition ordered as follows:

Respondents are directed to consider the case of petitioner for payment of ex-gratia for death due to electrocution within four (4) weeks from the date of receipt of copy of this order and also pay the amount within the time stated for by respondents. The miscellaneous applications, if any pending, as a sequel shall stand closed. There shall be no order as to costs.
