SMT JUSTICE T.RAJANI CRIMINAL PETITON No.6458 OF 2011 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C. seeking to quash the order, dated 27.05.2011, in P.R.C.No.7 of 2011 on the file of III Additional Judicial Magistrate of First Class, Kothagudem, whereunder the learned Magistrate taken cognizance against the petitioners under Sections 147, 148 and 307 read with 149 IPC.

Learned counsel for the petitioners submits that in fact the parties had compromised the matter, but since Section 307 IPC is added, the petitioners could not compromise the case, as it is not a compoundable office.

However, since charge sheet is already filed, the petitioners can file a petition seeking for discharge, before the concerned Court.

With the above liberty, the petition is dismissed.

Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
