THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 17690 of 2017 O R D E R :

Petitioner claims to be the owner and possessor of agricultural land in an extent of Acs.5.02 guntas in Survey No. 239 situated at Chintalapally Village, Pudur Mandal, Vikarabad District. While so, he is stated to have submitted an Application on 16.12.2013, along with requisite fee vide receipt No. 5621413, to the 6th respondent Mandal Surveyor seeking survey of the subject land. The legal notice got issued thereafter, in March 2014 and another application dated 20.05.2014 were not attended to. Hence, the petitioner filed an Application under the Right to Information Act on 12.04.2016 before the 4th respondent to provide the status of his earlier Applications. Subsequently also, on 08.05.2016, 23.05.2016 and 28.03.2017, the petitioner is stated to have filed Applications for survey of the schedule property, but no action has been taken thereon so far. Hence, this Writ Petition seeking a direction to Respondents 5 and 6 - Tahsildar and Mandal Survey of Pudur Mandal to conduct survey of the land, stated above.

Heard learned counsel for the petitioner as well as learned Government Pleader for Revenue (Telangana).

Considering the nature of the relief, which the petitioner has sought in this Writ Petition, subject to fulfilling the conditions prescribed for seeking conduct of survey and paying the necessary fee required therefor, after issuing notice to the petitioner as well as the neighbouring owners, it is directed that the respondent authorities shall conduct survey of the subject land and fix the boundaries, within six weeks from the date of receipt of a copy of this order. It is made clear that this direction shall not be

construed as this Court expressing any opinion on the right, title and ownership of the petitioner over the subject property, in any manner.

With the above, the Writ Petition is disposed of. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
