THE HONOURABLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.2619 of 2015 ORDER:
1. This Criminal Revision Case is filed by the petitioner aggrieved by the order 1.10.2015 passed in Crl.A.No.66 of 2015 by the Principal Sessions Judge, Karimnagar.
2. The 2nd respondent, who is the wife of the petitioner, filed DVC No.1 of 2014 before the Additional Judicial Magistrate of First Class, Karimnagar against the petitioner and his parents, sister and brother-in-law. Along with the above DVC, she filed Crl.M.P.No.3941 of 2014 before the learned Magistrate, seeking a direction to the petitioner to pay an amount of Rs.10,000/- per month towards her monthly maintenance. On 12.6.2015, the learned Magistrate passed orders in the above Crl.M.P. granting an amount of Rs.5,000/- per month towards interim maintenance to the 2nd respondent from the date of petition. Aggrieved by the same, the petitioner filed the above Criminal Appeal. The learned Sessions Judge partly allowed the appeal reducing the interim maintenance granted by the trial Court to Rs.3,000/- per month from Rs.5,000/- p.m. Being not satisfied with the order of the learned Sessions Judge, the petitioner filed this revision.
3. Heard and perused the material available on record.
4. There is no dispute as to the relationship between the parties. In view of the same and in view of the pendency of DVC case, without expressing any opinion on the merits of the case, this revision case is disposed of with the following direction: I) The petitioner is directed to pay Rs.1,500/- per month to the 2nd respondentwife towards interim maintenance on or before 10th of every succeeding month till disposal of the above DVC;
II) The petitioner is directed to pay the arrears of maintenance at the rate fixed by this Court from the date of filing of the petition i.e., Crl.M.P.No.3941 of 2014, within a period of three months from the date of receipt of a copy of this order; III) The trial Court is directed to dispose of the above DVC, as expeditiously as possible, without being influenced by the above order.
