HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN WRIT PETITON No.18490 of 2011 ORDER:

The relief sought for in the Writ Petition is to declare the action of the respondents, in threatening to demolish the tower erected by the petitioner at H.No.11-131/A, Sy. No.80/9, Autonagar, Gajuwaka Mandal, Visakhapatnam District even without issuing any notice and without giving them an opportunity, as arbitrary and illegal. By way of interim relief, a direction was sought to the respondent not to interfere with the tower erected by the petitioner.

Sri S. Lakshminarayana Reddy, Learned Standing Counsel for the Greater Visakhapatnam Municipal Corporation ("GVMC" for short) would submit that the GVMC would take action against the petitioner only after putting them on notice, and after giving them an opportunity of being heard.

In the light of the submission of the Learned Standing Counsel, it would suffice if the Writ Petition is disposed of permitting the respondent to take action against the petitioner for erection of the tower, after putting them on notice and giving them an opportunity of being heard.
