THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION No.4447 OF 2018 ORDER:

This criminal petition, under Section 438 of the Code of Criminal Procedure, 1973 (for short 'Cr.P.C.'), is filed by the petitioner/A.3 to release him on bail in the event of his arrest in connection with Crime No.43 of 2017 of Mattampally police station, Suryapet District, registered for the offence punishable under Sections 447, 326, read with 34 of the Indian Penal Code, 1860 (for short 'IPC').

Learned counsel for the petitioner, after arguing the matter for some time, requested this Court to issue a direction to the concerned Magistrate having jurisdiction to grant bail to the petitioner on his surrender.

Without going into the merits of the case, the petitioner is permitted to surrender before the concerned Magistrate, on such surrender and on filing an application under Sections 437 and 439 CrPC, concerned Magistrate is directed to decide the same on the same day, in accordance with law.
