Avunuri Suman v. The State Of Telangana,
THE HON'BLE SRI JUSTICE M.SEETHARAMA MURTI WRIT PETITION No.13115 OF 2018 ORDER:
In this writ petition, under Article 226 of the Constitution of India, the grievance of the writ petitioner is in respect of non-completion of the investigation in case in Crime No.110 of 2017 registered, on 19.06.2017, by the Station House Officer, Mandamarri Police Station, Mancherial District, despite the fact that the Law mandates that investigation into the crimes of the present nature shall be completed within a time frame. 2.
I have heard the submissions of Ms. N.Anula, learned counsel for the petitioner, and of the learned Government Pleader for Home (TG), appearing for respondent Nos.1, 2, 4, 5 and 7 to 9. I have perused the material record.
3.
Learned counsel for the petitioner would submit that the aforestated crime was registered for the offences punishable under Sections 120-B, 447, 427, 468 and 342 read with 149 I.P.C. & Section 3(i)(f)(q)(s) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Amendment Act, 2015; and that despite lapse of several months, there was no progress in investigation and that no charge sheet has been filed. 4.
Learned Government Pleader for Home, on written instructions, dated 16.04.2018, a copy of which is placed on record, would submit that investigation has made good progress; that the Investigation Officer is in the process of collection of certain documents, which are required for completion of
investigation; that a detailed report from the Mandal Revenue Officer concerned was received, on 12.04.2018; that efforts are being made to trace out the persons concerned for knowing the details of the disputed land; that investigation has made considerable progress; and that the present writ petition is filed for no reason; and, hence, the writ petition is not maintainable. 5.
Having regard to the facts and submissions, the Writ Petition is disposed of directing the Police Officer concerned, who is conducting investigation into the aforestated crime, to complete the investigation as expeditiously as possible and file a final report, either way, by strict adherence to the procedure established by law. There shall be no order as to costs.
Miscellaneous Petitions pending, if any, in this Writ Petition shall stand closed.
