23.11.2021 LK, J I.A.No. 1 of 2021 This Court by order dated 14.11.2021 has granted bail to petitioner and imposed a condition to appear before the Assistant Commissioner of Police, C-Division, CCS, DD, Hyderabad on every Monday between 10.00 A.M.
and 12.00 Noon until further orders.
Learned Senior Counsel Sri Hemendranath Reddy appearing for petitioner submits that petitioner has been complying with the conditions. The petitioner is a resident of Orissa and it has become very difficult for him to travel to Hyderabad on every Monday to attend before the police. He submits that petitioner was in judicial remand for 40 days and his custody was also sought. He submits that petitioner is ready to cooperate with the investigation and hence, the said condition may be relaxed.
On the other hand, learned Assistant Public Prosecutor submits that petitioner was released on bail only on 14.11.2021 and therefore, the condition may be kept intact.
Taking into consideration the facts and circumstances of the case, as the petitioner is complying with the conditions imposed by this Court and further, he is ready to cooperate with the investigation, this Court deems it appropriate to relax condition No. (ii) imposed vide order dated 14.11.2021. Petitioner is directed to appear before the investigating authorities whenever his presence is required.
