THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.1389 OF 2016 ORDER:

The criminal revision case is filed by the petitioner challenging the order, dated 04.05.2016, passed in Crl.M.P.No.910 of 2016 in S.C.No.172 of 2009 by the Court of the Metropolitan Sessions Judge, Hyderabad, whereby the Court below dismissed the petition filed by the petitioner to alter the charge from Section 22(c) to Section 22(a) of the Narcotic Drugs and Psychotropic Substances Act (NDPS Act). Heard and perused the records.

After arguing for some time, learned Senior counsel submits that the petitioner may be permitted to raise all the grounds raised herein as per the order, dated 05.11.2015, passed by this Court in Crl.R.C.No.2623 of 2015, before the Court below.

The criminal revision case is disposed of giving liberty to the petitioner to raise all the grounds raised herein, before the Court below, more particularly by placing reliance on the order, dated 05.11.2015, passed by this Court in Crl.R.C.No.2623 of 2015, and the Court below is directed to consider all the grounds raised by the petitioner herein and pass orders in accordance with law. The Criminal Revision Case is accordingly disposed of.
