HONOURABLE Dr. JUSTICE B.SIVA SANKARA RAO CRIMINAL PETITION No.7300 of 2017 ORDER :

Heard learned counsel for the petitioner/ A1, no other than father of the 2nd respondent/ de facto complainant and learned Public Prosecutor representing the State before ordering notice to respondent No.2 and perused the grounds urged in the quash petition and the contents of the F.I.R.

The endorsement in the F.I.R. clearly shows permission of the Magistrate as contemplated by Section 155 Cr.P.C. of registering crime basing on non-cognizable offence obtained is there. However, the dispute is between the son and father and the offences even allegedly punishable are Sections 109 and 506 I.P.C. Having regard to the above, for nothing to interdict the investigation, the investigation shall go on. However, pending investigation not to arrest the petitioner/ A1. But, this order does not prevent the police for securing the petitioner for the purpose of investigation, as and when required.

Accordingly, the Criminal Petition is disposed of. Consequently, miscellaneous petitions, if any, pending shall stand closed.
